Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. The relevant legal bases applicable in each individual case are set out in the following sections of this privacy policy.

Notice on Data Transfer to the USA and Other Third Countries

We use tools from companies based in the USA or other third countries that do not offer a level of data protection equivalent to that of the EU. Where these tools are active, your personal data may be transferred to and processed in these third countries. We wish to point out that no level of data protection comparable to that in the EU can be guaranteed in these countries. For example, US companies are required to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It cannot therefore be ruled out that US authorities (e.g. intelligence services) may process, analyse and permanently store your data held on US servers for surveillance purposes. We have no influence over these processing activities.

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You may withdraw consent you have already given at any time. The lawfulness of data processing carried out before the withdrawal remains unaffected.

Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)

WHERE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

WHERE YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work or place of the alleged breach. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Right to Data Portability

You have the right to have data which we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a commonly used, machine-readable format. Where you request direct transfer of the data to another controller, this will only be done where technically feasible.

Access, Rectification and Erasure

Within the framework of applicable legal provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients, and the purpose of the data processing and, where applicable, the right to rectification or erasure of this data. For this and any other questions on the subject of personal data, you can contact us at any time.

Right to Restriction of Processing

You have the right to request the restriction of processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the verification you have the right to request restriction of the processing of your personal data.

If the processing of your personal data was or is being carried out unlawfully, you may request restriction of data processing instead of erasure.

If we no longer need your personal data but you require it for the exercise, defence or establishment of legal claims, you have the right to request restriction of processing instead of erasure.

If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.

Where processing of your personal data has been restricted, such data may — with the exception of storage — only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

SSL and TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator. You can recognise an encrypted connection by the fact that the address bar of your browser changes from “http://” to “https://” and by the padlock symbol in your browser bar.

When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to Promotional Emails

The use of contact details published as part of the imprint obligation for the purpose of sending unsolicited advertising and information materials is hereby expressly prohibited. The operators of this website expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, for example by spam emails.

Cookies

Our website uses what are known as “cookies.” Cookies are small data packages that do not cause any damage to your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your device. Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or your web browser automatically deletes them.

Cookies can originate from us (first-party cookies) or from third-party companies (third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them. Other cookies may be used to analyse user behaviour or for advertising purposes.

Cookies that are necessary for carrying out the electronic communication process, for providing certain functions that you have requested, or for optimising the website are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing takes place exclusively on the basis of that consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent may be withdrawn at any time.

You can configure your browser to inform you about the setting of cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when you close the browser. If cookies are disabled, the functionality of this website may be limited.

You can find out which cookies and services are used on this website in this privacy policy.

Our website uses Cookiebot consent technology to obtain your consent to the storage of certain cookies in your browser or to the use of certain technologies and to document this in a data protection compliant manner. The provider of this technology is Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark (hereinafter “Cookiebot”).

When you enter our website, a Cookiebot cookie is stored in your browser in which the consents you have given or the withdrawal of these consents are stored. This data is not passed on to the provider of Cookiebot.

The data collected will be stored until you ask us to delete it, delete the Cookiebot cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention periods remain unaffected. Details on the data processing of Cookiebot can be found at: https://www.cookiebot.com/en/privacy-policy/

The use of Cookiebot consent technology is carried out in order to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Data Processing Agreement

We have concluded a Data Processing Agreement (DPA) with the above provider. This is a contract required by data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

— Browser type and browser version
— Operating system used
— Referrer URL
— Hostname of the accessing device
— Time of the server request
— IP address

This data is not merged with other data sources. The collection of this data is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website — for this purpose server log files must be recorded.

Contact Form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR where your enquiry relates to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) where this has been requested; consent may be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to storage, or the purpose for data storage no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions — in particular statutory retention periods — remain unaffected.

Enquiries by Email

If you contact us by email, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request.

The data you send us by email will remain with us until you ask us to delete it, withdraw your consent to storage, or the purpose for data storage no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions — in particular statutory retention periods — remain unaffected.

5. Social Media

Social Media Elements with Shariff

This website contains elements of social media platforms. These elements can usually be identified by the respective social media logos. In order to ensure data protection on this website, we use these elements only together with the so-called “Shariff” solution. This application prevents the social media elements integrated on this website from transmitting your personal data to the respective provider as soon as you first enter the page.

A direct connection to the provider’s server is only established when you activate the respective social media element by clicking the associated button (consent). As soon as you activate the social media element, the respective provider receives the information that you have visited this website with your IP address. If you are simultaneously logged into your respective social media account, the respective provider can assign the visit to this website to your user account.

Activating the element constitutes consent within the meaning of Art. 6(1)(a) GDPR and § 25(1) TDDDG. You may withdraw this consent at any time with effect for the future.

This service is used in order to obtain the legally required consents for the use of certain technologies. The legal basis for this is Art. 6(1)(c) GDPR.

Instagram

This website contains functions of the Instagram service and may embed Instagram content. These functions are offered by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

When the social media element is active, a direct connection is established between your device and the Instagram server. Instagram thereby receives information about your visit to this website.

If you are logged into your Instagram account, you can link the content of this website with your Instagram profile by clicking the Instagram button. This allows Instagram to assign the visit to this website to your user account. We wish to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by Instagram.

Where consent has been obtained, the above service is used on the basis of Art. 6(1)(a) GDPR and § 25 TDDDG. Consent may be withdrawn at any time. Where no consent has been obtained, use of the service is based on our legitimate interest in achieving the broadest possible visibility on social media.

Where personal data is collected on our website using the tool described here and forwarded to Facebook or Instagram, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its forwarding to Facebook or Instagram. The processing carried out by Facebook or Instagram after the forwarding is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. The text of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the data protection information when using the Facebook or Instagram tool and for the data protection secure implementation of the tool on our website. However, Google Tag Manager does collect your IP address, which may also be transmitted to Google’s parent company in the United States.

The use of Google Tag Manager is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and management of various tools on its website. Where consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. No assignment to a user ID takes place.

Furthermore, we can use Google Analytics to record your mouse and scroll movements and clicks, among other things. Google Analytics also uses various modelling approaches to supplement the collected data sets and uses machine learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is generally transmitted to a Google server in the USA and stored there.

This website uses the visitor action pixel from Facebook/Meta for conversion measurement. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, the data collected is also transferred to the USA and other third countries.

This allows the behaviour of page visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. This enables the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous to us as the operator of this website — we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data use policy (https://www.facebook.com/about/privacy/). 7. Newsletter

Newsletter Data

To receive the newsletter offered on this website, we require your email address as well as information that allows us to verify that you are the owner of the email address provided and that you consent to receiving the newsletter. No further data is collected or only on a voluntary basis. We use newsletter service providers to handle our newsletters, which are described below.

Kit (formerly ConvertKit)

This website uses Kit for sending newsletters. The provider is ConvertKit LLC, 750 N San Vicente Blvd, Suite 800W, West Hollywood, CA 90069, USA.

Kit is a service that can be used, among other things, to organise and analyse the sending of newsletters. The data you enter for the purpose of receiving the newsletter is stored on Kit’s servers in the USA.

Data Analysis by Kit

With the help of Kit, we are able to analyse our newsletter campaigns. For example, we can see whether a newsletter message has been opened and which links have been clicked. In this way we can determine, among other things, which links have been clicked particularly often.

We can also determine whether certain predefined actions have been carried out after opening or clicking (conversion rate). We can thus determine, for example, whether you have made a purchase after clicking on the newsletter.

Kit also allows us to segment newsletter recipients into different categories. This allows newsletter recipients to be divided according to various criteria in order to better tailor newsletters to the respective target groups. If you do not want Kit to analyse your data, you must unsubscribe from the newsletter. We provide a corresponding link in every newsletter message for this purpose.

For detailed information on the functions of Kit please visit: https://kit.com

Kit’s privacy policy can be found at: https://kit.com/privacy

Legal Basis

Data processing is carried out on the basis of your consent (Art. 6(1)(a) GDPR). You may withdraw this consent at any time. The lawfulness of data processing operations already carried out remains unaffected by the withdrawal.

Data transfer to the USA is based on the EU Commission’s Standard Contractual Clauses. Details can be found here: https://kit.com/privacy

Retention Period

The data stored with us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe. Data stored by us for other purposes remains unaffected.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider on a suppression list if this is necessary to prevent future mailings. The data from the suppression list will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). The storage on the suppression list is not limited in time. You may object to the storage if your interests outweigh our legitimate interest.

When you visit this website, your browser loads the required fonts from Google’s servers in order to display texts and fonts correctly. This establishes a connection to Google’s servers and your IP address is transmitted to Google.

The use of Google Fonts is based on your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG. Consent may be withdrawn at any time.

Data transfer to the USA is based on the EU Commission’s Standard Contractual Clauses. Details can be found in Google’s privacy policy: https://policies.google.com/privacy

Such content includes in particular cloud recordings, chat and instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during use of the service.

Please note that we do not have full control over the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Further information on data processing by the conferencing tools can be found in the privacy policies of the tools we use, which are listed below.

Purpose and Legal Bases

The conferencing tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us (legitimate interest within the meaning of Art. 6(1)(f) GDPR).
